1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and Auditech Consulting LLC, doing business as Casso ("Casso," "we," "us," or "our"), governing your access to and use of the Casso platform, including our website, applications, and services (collectively, the "Service").

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Service.

2. Description of Service

Casso is a customer support ticketing platform that helps organizations manage customer communications. The Service includes:

  • Email-to-ticket conversion and management
  • Team collaboration and ticket assignment
  • Customer portal for ticket tracking
  • AI-powered ticket analysis and suggestions
  • Customer satisfaction surveys
  • Reporting and analytics

3. Account Registration

To use certain features of the Service, you must create an account. You agree to:

  • Provide accurate, current, and complete information during registration
  • Maintain and promptly update your account information
  • Keep your password secure and confidential
  • Accept responsibility for all activities under your account
  • Notify us immediately of any unauthorized use of your account

You must be at least 18 years old to create an account and use the Service.

4. Acceptable Use

You agree not to use the Service to:

  • Violate any applicable laws or regulations
  • Infringe on the rights of others
  • Send spam, unsolicited communications, or malicious content
  • Attempt to gain unauthorized access to the Service or other systems
  • Interfere with or disrupt the Service or servers
  • Upload viruses, malware, or other harmful code
  • Collect user information without consent
  • Impersonate any person or entity

5. Billing and Subscriptions

Pricing: The Service is offered on a subscription basis with seat-based pricing. Current pricing is available on our website.

Free Trial: We offer a 14-day free trial for new organizations. No credit card is required to start the trial.

Billing Cycle: Subscriptions are billed monthly in advance. Your subscription will automatically renew each month unless cancelled.

Payment: Payments are processed through Stripe. By providing payment information, you authorize us to charge your payment method for the subscription fees.

Cancellation: You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period. No refunds are provided for partial months.

Price Changes: We may change our prices with 30 days notice. Continued use of the Service after price changes constitutes acceptance of the new prices.

6. Your Content

You retain ownership of all content you submit to the Service ("Your Content"), including emails, tickets, attachments, and other data. By using the Service, you grant us a limited license to process, store, and display Your Content as necessary to provide the Service.

You represent that you have all necessary rights to Your Content and that Your Content does not violate any laws or infringe on any third-party rights.

7. Intellectual Property

The Service, including its original content, features, and functionality, is owned by Auditech Consulting LLC and is protected by copyright, trademark, and other intellectual property laws. Our trademarks may not be used without our prior written consent.

8. Third-Party Services

The Service integrates with third-party services including Stripe (payments), Mailgun (email processing), and AI services (ticket analysis). Your use of these services is subject to their respective terms and privacy policies.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, AUDITECH CONSULTING LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM OR RELATING TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

11. Indemnification

You agree to indemnify, defend, and hold harmless Auditech Consulting LLC and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

12. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Service will cease immediately.

You may export your data before termination. After termination, we may delete your data in accordance with our data retention policies.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Missouri, United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the state or federal courts located in Missouri.

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on our website and updating the "Last updated" date. Your continued use of the Service after changes become effective constitutes acceptance of the revised Terms.
